Acceptable Use Policy

1. Prohibited Content

You may not create, upload, transmit, generate, or facilitate the creation or transmission of content that:

• Child sexual abuse material (CSAM). Any content that sexually depicts, exploits, or abuses minors, or that could be used to groom, exploit, or harm children. This is a zero-tolerance policy. We will immediately terminate the account, preserve evidence, and report the conduct to the National Center for Missing & Exploited Children (NCMEC) and appropriate law enforcement.
• Non-consensual intimate imagery (NCII). Nude, sexual, or intimate images or depictions of real individuals without their explicit consent ("revenge porn" or deepfake NCII). This includes AI-generated depictions that realistically portray an identifiable real person in a sexual or intimate context without consent.
• Violent extremism and terrorism. Content that promotes, glorifies, recruits for, funds, or facilitates acts of terrorism, mass violence, genocide, or violent extremist ideologies.
• Incitement to violence. Content that directly incites violence against specific individuals or groups based on characteristics such as race, ethnicity, religion, gender, sexual orientation, disability, or national origin.
• Illegal content. Any content that violates applicable federal, state, local, or international law or regulation.

2. Identity, Impersonation, and Photo Uploads

• No unauthorized photos. You may only upload photographs for which you have the legal right to do so. You must have the subject’s freely given, specific, and informed consent to upload their photograph for avatar creation. Uploading photographs of another person without consent may violate privacy law, publicity rights, and biometric privacy statutes (e.g., Illinois BIPA).
• No misleading impersonation. You may not create characters designed to mislead others into believing they are communicating with a real, specific individual (e.g., creating a character that impersonates a specific living public figure or private individual in a deceptive, defamatory, or fraudulent manner).
• Fan characters and fictional depictions. Fan-created characters inspired by public figures are permitted, provided they are clearly labeled as fictional (not presented as the actual person), are not sexually explicit, and are not used to spread false statements of fact, harass the individual, or otherwise cause harm.
• No false identity. You may not misrepresent your identity, affiliation, or authorization when interacting with the Service or other users.

3. Harassment, Threats, and User Safety

• No harassment or threats. You may not use the Service to harass, threaten, stalk, bully, intimidate, or cause emotional distress to any individual, including other users, employees of SplatChat, or third parties.
• No doxxing. You may not use the Service to solicit, publish, or facilitate the publication of private personal information about any individual without their consent (including name, address, phone number, workplace, financial information, or other identifying information).
• No coordinated harm. You may not use the Service to organize or coordinate harassment campaigns targeting specific individuals or organizations.

4. Protection of Minors

• You may not use the Service to engage in any conduct that exploits, endangers, or harms minors, or that could be used to groom, solicit, or coerce a minor.
• You may not create characters specifically designed to deceive minors into harmful interactions.
• Users under 13 may not use the Service. Users between 13 and 17 must have parental consent and supervision as described in our Terms of Service.

5. Intellectual Property

• You may not upload, transmit, or incorporate content that infringes the copyright, trademark, patent, trade secret, right of publicity, or other intellectual property rights of any third party.
• You may not use the Service to reproduce or distribute copyrighted material at scale without authorization.
• All character-related content you create — including character configurations, uploaded photographs, generated blog posts, and generated documents — must comply with applicable intellectual property laws. You are solely responsible for ensuring that this content does not infringe third-party rights.
• Copyright infringement reports are handled under our DMCA Policy.

6. Meeting Bot Conduct and Disclosure Requirements

The Meeting Bot feature allows AI characters to join and participate in live meetings. Because meeting bots process audio from all participants — not just the user who deployed the bot — specific conduct requirements apply. Violations of this section may constitute unlawful wiretapping, eavesdropping, or electronic surveillance and may expose you to civil and criminal liability.

6.1 Mandatory disclosure

• Disclose before the bot speaks. You must clearly inform all meeting participants — before the bot joins or immediately upon it joining — that an AI-powered virtual assistant is present and processing audio. A brief announcement is sufficient (e.g., “I’ve added a SplatChat AI assistant to this meeting. It will participate in the conversation and process our audio.”).
• Cannot be waived by platform labels alone. If the meeting platform does not automatically label or announce the bot’s presence in a way that is clearly visible and understood by all participants, you must make an explicit verbal or written disclosure.

6.2 Consent and recording law compliance

• You must comply with all applicable laws governing the interception, monitoring, or recording of communications. These include, without limitation:
  • The U.S. Electronic Communications Privacy Act (18 U.S.C. §§ 2510–2523);
  • State all-party-consent laws (e.g., California Penal Code § 632, Illinois 720 ILCS 5/14-2, Maryland Courts & Judicial Proceedings § 10-402, Washington RCW 9.73.030, and similar statutes in other states);
  • Equivalent laws in non-U.S. jurisdictions where any meeting participant is located.
• In all-party-consent jurisdictions, you must obtain the consent of every meeting participant before the bot processes their audio. You bear sole responsibility for obtaining, documenting, and retaining evidence of such consent.
• If any participant objects to the bot’s presence, you must immediately remove the bot from the meeting.

6.3 Meeting platform terms of service

• You are responsible for ensuring your use of Meeting Bots complies with the terms of service of the underlying platform (Google Meet, Zoom, Microsoft Teams, or any other platform). SplatChat makes no representation that bot usage is permitted by any platform’s terms and is not liable for any consequences of platform violations.
• You may not use Meeting Bots on any platform in a manner that violates that platform’s policies, including any restriction on automated participants, recording, or scraping.

6.4 Prohibited meeting bot uses

• No covert surveillance. You may not use a Meeting Bot to secretly monitor, intercept, or record the communications of others without their knowledge and consent.
• No privileged communications capture. You may not deploy a Meeting Bot into a legally privileged communication (attorney-client, physician-patient, therapist-client, etc.) unless all parties to that privilege have expressly consented in writing.
• No unauthorized competitive intelligence. You may not deploy Meeting Bots to intercept confidential business communications of competitors or other organizations without their knowledge and consent.
• No deceptive personas. You may not configure a Meeting Bot to impersonate a real, identifiable human being in a way designed to deceive other meeting participants into believing they are speaking with a person rather than an AI.

7. Social Media and Third-Party API Tools

The SplatChat MCP server and Developer API expose tools that can interact with social media platforms and other third-party services on your behalf, including posting content, replying, following, liking, sending messages, and performing searches on platforms such as X (Twitter). The following conduct requirements apply to all such use.

• Platform terms compliance. You must comply with the terms of service, automation policies, and rate limits of every platform you interact with via SplatChat tools. SplatChat is not responsible for account suspensions, bans, or legal consequences resulting from violations of platform terms.
• No spam or coordinated inauthentic behavior. You may not use social tools to send unsolicited bulk messages, artificially inflate engagement metrics, coordinate inauthentic behavior, or manipulate platform algorithms in violation of platform policies or applicable law.
• No harassment or threats. You may not use social tools to harass, threaten, stalk, or send abusive messages to any individual.
• No impersonation. You may not use social tools to post content, send messages, or otherwise act in a way that impersonates a real person or organization without their authorization.
• No disinformation. You may not use social tools to knowingly spread false information that could deceive the public or cause harm.
• Lawful use only. You may not use social tools in violation of the Computer Fraud and Abuse Act, the CAN-SPAM Act, or any other applicable law governing electronic communications.
• Your responsibility. All content posted or actions taken via social tools are performed on your behalf and with your authorization. You are solely responsible for that content and those actions. SplatChat is not a publisher of social media content generated through your use of the Service.

8. Third-Party Integration Usage

When you connect third-party services (such as Linear, HubSpot, Gmail, Outlook, Salesforce, or Pipedrive) to your account, AI characters and Meeting Bots can take actions within those services. The following conduct requirements apply.

• Authorized scope only. AI actions within connected services must stay within the scope of the permissions you granted when connecting the integration. You may not configure AI to exceed your authorized access within a third-party system.
• No unauthorized access. You may not connect services using credentials that are not yours or that you are not authorized to use. You may not use integrations to access data belonging to other users or organizations without their consent.
• Third-party terms compliance. Your use of integrations must comply with the terms of service of each connected platform. You are responsible for ensuring that automated AI actions within those platforms are permitted by their terms.
• Review before authorizing consequential actions. AI-generated actions within connected services (e.g., sending emails, creating records, updating CRM data) may have real-world consequences. You are solely responsible for reviewing authorized action types and ensuring they align with your intent.

9. Security and Technical Abuse

• No reverse engineering. You may not attempt to extract, decompile, disassemble, reverse-engineer, or otherwise derive the source code, model weights, rendering pipeline, or other proprietary technology underlying the Service.
• No circumvention. You may not circumvent, disable, or bypass any authentication mechanism, rate limit, access control, safety filter, or security measure in the Service.
• No denial-of-service attacks. You may not introduce malware, ransomware, viruses, worms, or other malicious code, or engage in denial-of-service or distributed denial-of-service attacks against the Service or any third party.
• No unauthorized scraping. You may not use automated means (bots, scrapers, crawlers) to access, extract, or index content from the Service beyond what is permitted by these Terms or our API documentation.
• No vulnerability exploitation. You may not probe, scan, or test the vulnerability of the Service or any related systems without our prior written consent. If you discover a security vulnerability, please report it responsibly to legal@splatchat.com.
• No credential sharing or resale. You may not share, sell, or transfer your account credentials, API keys, or session tokens. You are responsible for all activity under your account.

10. Competitive and Commercial Misuse

• You may not use the Service to develop, train, or benchmark a competing product without our prior written consent.
• You may not use the Service to collect data for competitive intelligence purposes without our prior written consent.
• API access is subject to the rate limits and usage policies described in our Terms of Service. Abuse of the API (including attempts to circumvent rate limits) is prohibited.

11. Export Controls and Sanctions

You may not use the Service in violation of applicable export control laws, regulations, or sanctions, including those administered by the U.S. Office of Foreign Assets Control (OFAC) and the U.S. Bureau of Industry and Security (BIS). You may not access or use the Service from a jurisdiction subject to a comprehensive U.S. government trade embargo (including, as of the date of this AUP, Cuba, Iran, North Korea, Russia, Syria, and Crimea), or if you are on any U.S. government denied-party list.

12. Enforcement

We reserve the right to investigate any suspected violation of this AUP. We may, at our sole discretion:

• Issue a warning.
• Temporarily suspend access to the Service or specific features (including Meeting Bots, social tools, or integrations).
• Permanently terminate your account and revoke all licenses granted under the Terms of Service.
• Remove or disable access to content that violates this AUP.
• Report unlawful conduct to law enforcement, including the NCMEC for CSAM.
• Take legal action to prevent or address violations.

We may take action with or without prior notice, depending on the severity of the violation. We are not obligated to monitor all content on the Service but may do so to detect and address violations.
